I hereby declare the information in this application is true and complete. I understand that providing false information is grounds for rejection of this application, and if discovered after hired, is also grounds for dismissal. I authorize investigation of all statements contained herein and the references and employers listed above to give you any and all information they may have, and release the company from all liability for any damage that may result from utilization of such information. 

In order to work with minors in the public schools, a background check is necessary along with fingerprints to be in compliance with the JLA (Jessica Lunsford Act).  Are you able to comply with this requirement? If no, please specify.

 

Indemnification and Hold Harmless Agreement

The above named user (herein referred to as the "Releasor") of Flying Beach Yoga, LLC and/or Kula Yoga Kids, LLC property for itself, its employees, agents, or servants hereby agrees to indemnify and hold harmless Flying Beach Yoga, LLC and/or Kula Yoga Kids, LLC its members, employees, agents, or servants (herein collectively referred to as the "Yoga Releasees"), for any loss which Yoga Releasees may suffer as a result of any claim, action, or lawsuit which may be brought against it by any person or persons claiming injury to person or property, including intellectual property resulting in any way from the use of Flying Beach Yoga or Kula Yoga Kids property by Releasor, its agents, servants, invitees, and/or employees.

It is hereby understood that the obligation of indemnification will be enforceable by Flying Beach Yoga or Kula Yoga Kids, notwithstanding the fact that any claim or damage to person or property be resolved by mutual agreement of Flying Beach Yoga and/or Kula Yoga Kids and the person or persons claiming injury to person or property.  Flying Beach Yoga and Kula Yoga Kids expressly retains all rights, benefits, and immunities of sovereign immunity in accordance with Section 768.28, Florida Statutes.  Notwithstanding anything set forth in any section of this agreement to the contrary, nothing in this agreement shall be deemed as a waiver of immunity or limits of liability of Flying Beach Yoga and/or Kula Yoga Kids belong any statutory limited waiver of immunity or limits of liability which may have been adopted by the Florida Legislature or may have been adopted by the Florida Legislature and the cap on the amount and liability of either party for damages, attorney's fees and costs regardless of the number or nature of claims in tort, equity or contract shall not exceed the dollar amount set by the legislature for tort. 

Indemnification will include in addition to any sums paid to the claimant, any attorney fees, litigation costs or other charges sustained by Flying Beach Yoga and/or Kula Yoga Kids as a direct result of the negligent and/or intentional conduct of the user, its agents, servants, invitees, and/or employees.
